Machinery

The adoption of technical regulations in the field of safety of machinery is under the authority of Ministry of Economy - Sector for Quality and Products Safety.

For the purpose of alignment to Directive 2006/42/EC, i.e. amendments thereto set out in Directive 2009/127/EC, Minister of Economy adopted the new Rulebook on Machinery Safety which has been published in the „Official Gazette of RS”, No. 58/16 and 21/20. This rulebook entered into force on 1 June 2016 and implementation starts from 1 September 2016.

The Rulebook stipulates, for the first time, the specific essential health and safety requirements for the protection of the environment applicable to the machinery for pesticide application. These esential requirements are set out in Annex 1 section 2.4. of the new rulebook.

Besides the alignment to the EU legislation in relation to the machinery for pesticide application, the new rulebook repeals the obligation of obtaining Confirmation of Conformity for certain categories of machinery. From the date of entry into application of the new rulebook the obligation of obtaining Confirmation of Conformity shall apply only to portable tools with electrical motors designed for voltages up to 250 V AC for domestic or similar use.

The Rulebook on Amendments and Modifications of the Rulebook on safety of Machinery, ("Official Gazette of RS" No 21/2020), which repeals the obligation of obtaining Confirmation of Conformity for all categories of machinery, starting from january 1. st 2022, has been published in March 6 th, 2020.

Previously, this field was governed by the Machinery Safety Rulebook, which was published on March 12, 2010 in “Official Gazette of the RS”, No 13/10. This Rulebook was fully harmonised with all the principles and essential requirements of Directive 2006/42/EC of the European Parliament and the Council of 17 May 2006 on machinery. In the course of preparation of this rulebook, in addition to the above EU directive, the solutions from the reference EU regulations in the field of technical legislation were also taken into account, in particular from the Decision 768/2008/EC of the European Parliament and the Council on a common framework for the marketing of products.

Legal basis for adoption of this Rulebook is the Law on Technical Requirements for Products and Conformity Assessment ("Official Gazette of the RS", No 36/2009).

The Rulebook is accompanied by a List of Serbian standards in the field of machinery which is regularly updated in accordance with the list of harmonised standards published in the Official Journal of the EU. On January 17, 2020, the latest list of Serbian standards in the field of machinery was published in "Official Gazette of the RS", No 3/20.

The Guide to implementation of the Machinery Safety Rulebook was published, series of activities were performed for improvement of infrastructure for conformity assessment, i.e. surveillance of the implementation of the new framework for marketing of these products and seminars in view of promotion of the Rulebook and the Guide to implementation of the Machinery Safety Rulebook.
